These Terms of Service ("Terms") are a binding agreement between you and wello ("wello", "we", "us") and govern your use of the wello mobile application and the website at welloapp.co (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
Medical disclaimer. wello is an informational and organisational tool — not a medical device, and not a substitute for professional medical advice, diagnosis or treatment. Any summaries, reminders or interpretations it provides (including plain-language explanations of lab results) are for general information only. Always seek the advice of a qualified physician or pharmacist with any questions about a medical condition or medication. Never disregard or delay professional medical advice because of something you read in wello. In an emergency, call your local emergency number immediately.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using wello to manage care for another person, you confirm you are authorised to record and process their information (for example, as a family member, caregiver, or lawful guardian).
2. Your account
- You sign in using your mobile number and a one-time password. You are responsible for keeping access to your phone and account secure.
- You agree to provide accurate information and to keep it up to date.
- You are responsible for activity that happens under your account, and for the caregivers you invite into a care circle.
3. Licence to use wello
Subject to these Terms, wello grants you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the app on devices you own or control, solely for your personal, non-commercial use of caring for yourself or your family. This is a licence, not a sale; we retain all rights in the Service.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Upload data about another person without the right to do so.
- Reverse-engineer, decompile, copy, resell or commercially exploit the Service, except where this restriction is prohibited by law.
- Interfere with, disrupt, or attempt to gain unauthorised access to the Service or other users' data.
- Rely on the Service as a medical, diagnostic or emergency tool.
5. Your content
You keep ownership of the records, notes and files you add to wello ("Your Content"). You grant us a limited licence to host, process and display Your Content only as needed to operate the Service for you and your care circle — for example, to store records, deliver reminders, and generate summaries. We handle Your Content as described in the Privacy Policy.
6. Third-party services
The Service relies on third parties such as cloud hosting, an SMS provider for login codes, and an AI text provider used to summarise lab values. Your use of the Service through Apple's App Store or Google Play is also subject to those platforms' terms. We are not responsible for third-party services we do not control.
7. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that reminders or summaries will always be timely or accurate. You remain solely responsible for all health decisions.
8. Limitation of liability
To the maximum extent permitted by law, wello and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from missed reminders, reliance on summaries, or use of or inability to use the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or ₹2,000 (or its equivalent). Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Indemnity
You agree to indemnify and hold wello harmless from claims and expenses arising out of your misuse of the Service, your violation of these Terms, or your violation of any rights of another person, including the people whose data you record.
10. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service and its users. On termination, your licence ends; data deletion follows our Privacy Policy.
11. Changes to the Service and these Terms
We may change or discontinue features, and we may update these Terms. For material changes we will give reasonable notice in the app or by email. Continued use after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of India, and you agree to the exclusive jurisdiction of the courts at Bengaluru, Karnataka, subject to any rights you have as a consumer under applicable law.
